1. Acceptance of Terms
By accessing or using the Kithly website or mobile application (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
2. The Service
Kithly provides a platform for users ("Organizers") to create group video gifts ("Video Cards") by collecting video messages and content ("User Content") from contributors.
3. User-Generated Content
You are solely responsible for the User Content that you upload, submit, or display on the Service. You represent and warrant that you own all rights to your User Content or have the necessary rights to grant us the license below.
You retain full ownership of your User Content. You grant Kithly a limited, non-exclusive, royalty-free license to use, reproduce, transcode, and display your User Content solely for the purpose of operating and providing the Service.
4. Prohibited Conduct
You agree not to use the Service to:
- Upload or share any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
- Infringe upon any party's intellectual property rights, including copyright and trademark.
- Upload any content that contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware.
5. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. Kithly makes no warranties, expressed or implied, and hereby disclaims all other warranties, including without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
6. Limitation of Liability
In no event shall Kithly or its owner, Dimuthu Wickramanayake, be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.
